TERMS AND CONDITIONS:

Prices listed do not include travelling expenses.

If the event takes place outside of the Wellington area, accommodation costs (if required) will be additional.

A 30% deposit is required within 14 days of signing the agreement.

The remaining money is to be paid 14 days prior to the event.

If full payment is not made within 72 hours of the event, the DJ has the right to cancel his services and the 30% deposit will not be refunded.

The client may cancel their agreement if services are no longer required. If cancellations are made within 72 hours, the client will be entitled to a refund of any money paid, except for the non-refundable deposit.

The DJ may cancel this agreement due to circumstances beyond the DJ’s control. This notice needs to be made within 72 hours of the event. If the DJ cancels, they may suggest a suitable replacement DJ, subject to client’s approval, which shall be obtained in writing. In the alternative, DJ shall refund all money previously paid by the client, including the deposit.

Dispute Resolution and Legal Fees. In the event of a dispute that cannot be resolved by mutual agreement, the parties agree to engage in mediation. If the matter cannot be resolved through mediation, and legal action ensues, the successful party will be entitled to its legal fees, including, but not limited to its attorneys’ fees.

Severability. In the event any provision of the agreement is deemed invalid or unenforceable, in whole or in part, that part shall be severed from the remainder of the agreement and all other provisions should continue in full force and effect as valid and enforceable.

Governing Law and Jurisdiction. The parties agree that this agreement shall be governed by the state and/or country in which both parties do business. In the event that the parties do business in different states and/or countries, this agreement shall be governed by either state.
